England's new levy charges developers per square metre of new residential floorspace - rates set in law for each local authority area, higher where house prices are higher. It lands through the building control process and must be paid before completion or occupation, whichever is earlier. If you develop 10 or more dwellings, the question is not whether it applies, but how much it costs and which exemptions you can prove.

| Trap | How it works |
|---|---|
| Phasing trap | Splitting a 24-dwelling permission into three 8-dwelling applications does not avoid the levy - the planning permission scale is what counts |
| Resubmission trap | A pre-October 2026 application that is rejected and resubmitted becomes liable |
| Change-of-use trap | Converting an existing building into dwellings can be chargeable too |
| Cash-flow trap | Payment falls due before completion or occupation - earlier than most developers expect |
| Exemption-evidence trap | Social housing, supported housing and other uses can be exempt dwellings - but get the exemption confirmed in writing by the local authority |
A discounted rate applies to qualifying "previously developed" (brownfield) sites, defined in the regulations.
What it is not: templates and worksheets, not legal or tax advice. The collecting authority's levy liability notice is the actual bill - this pack gets you ready for it.

My site is 8 dwellings. Am I clear? Only if the planning permission is for under 10 dwellings (or under 30 PBSA bedspaces). If the wider permission is a major residential development, your smaller application is still chargeable. And exempt dwellings (social, supported) do not count toward the charge but do not shrink the development's status either.
Where do I find my rate? The rates are set per local authority area in the levy regulations (SI 2025/1236), weighted by house prices. The estimator takes your area's rate as an input and links you to the rate table.
Is this advice? No. It is a worksheet and checklist pack built from the GOV.UK levy guidance and the regulations. For a live project, confirm with the collecting authority or a qualified adviser.
